"When the strike ended, we had a surplus of employees. Because we were still in that probationary period with those workers, we chose not to bring them back," said Caterpillar spokeswoman Marsha Hausser.

She said they were called back later because the company needed more workers. The National Labor Relations Board was going to issue a complaint on behalf of the 12 workers in Decatur, said NLRB regional attorney Stephen Shostrom, but the workers have withdrawn their charges. The status of workers fired during the long contract dispute 101 people altogether has been a key hurdle to a new contract. The old contract expired Sept. 30, 1991.

NLRB Region 33 Director Glenn Zipp filed a complaint early this month requesting the reinstatement of 11 other workers terminated shortly after the strike. He also filed a complaint consolidating charges regarding eight veteran workers who were fired. Complaints go before an administrative law judge for a recommendation, then to an NLRB panel for a ruling. If Caterpillar appeals as it has each time in the past, it could end up in federal court, which could mean years before a final ruling is issued. pillar Inc.

(AP) A $1.5 million verdict against American Honda Motor Co. was thrown out Tuesday by New Hampshire's Supreme Court because of inflammatory anti-Japanese remarks by an opposing lawyer. Honda and the operator of one of its all-terrain vehicles had been ordered on Nov. 19, 1993, to pay a total of $2.1 million for injuries suffered by Thomas LeBlanc. LeBlanc's leg was severely injured in 1988 when a snowmobile on which he was a passenger collided with a Honda Odyssey, a now-discon tinued, one-person vehicle.

It bears no resemblance to Honda's current Odyssey minivan. During the trial, LeBlanc's lawyer, Vincent C. Martina, asked an expert witness if he had ever wondered why the Odyssey was "red, white and blue, the color of the American flag?"
