That much is certain.

But how much Caremark Rx Inc. charges for each prescription is a mystery. So are the administrative costs the state pays and the amount that pharmacies get for joining the program. Caremark and Gov. Rod Blagojevich's administration won't release that information, calling it a trade secret.

But lawmakers and pharmacists argue it is impossible to tell whether Illinois is getting its money's worth if the contract's details are secret. The dispute has turned into a court battle. After two state senators filed a Freedom of Information Act request for details about the contract, Caremark obtained a restraining order barring state Comptroller Dan Hynes from releasing it. A hearing on the request is now scheduled for Friday in Cook County Circuit Court. Government officials and public information experts say they cannot recall another time when lawmakers have had to go to court for access to a state contract.

"At this point, you have to ask yourself what's the secret?" said Sen. Peter Roskam, R-Wheaton. The lawmaker says he was prompted to seek information about the contract after hearing complaints from pharmacists in his district. They worry Caremark is overcharging them and taxpayers. "We would love for (the lawmakers) to see how much this program is costing the state of Illinois unwittingly," said Mike Patton, executive director of the Illinois Pharmacists Association.

The state signed a contract with Caremark in 2002, before Blagojevich took office, to provide mail-order prescription drugs to state employees, their dependents and government retirees.
